1. About These Terms
These Terms and Conditions apply to your use of the DistingStyle website and to orders placed through https://distingstyle.com.
Please read these Terms before placing an order. By submitting an order, you agree to these Terms together with our:
- Privacy Policy.
- Cookie Policy.
- Shipping Policy.
- Refund and Returns Policy.
Nothing in these Terms affects your statutory consumer rights.
2. Company Information
The website is operated by:
DistingStyle LTD
Company number: 17062339
Registered in England and Wales
Registered office:
157 Woodcock Lane
Northfield
Birmingham B31 1BU
United Kingdom
Email: support@distingstyle.com
Website: https://distingstyle.com
Our registered office is not a public shop, collection point or returns address. Do not send products to this address unless we specifically instruct you to do so.
3. Eligibility to Order
To place an order, you must:
- Be at least 18 years old or have the permission and supervision required by applicable law.
- Have legal capacity to enter into a contract.
- Provide accurate and complete contact, billing and delivery information.
- Be authorised to use the selected payment method.
We may carry out reasonable payment, identity, fraud-prevention or address checks before accepting or dispatching an order.
4. Our Products
DistingStyle offers original artwork, handmade soaps, candles, home décor and other handmade or small-batch products.
Product availability may change. Original artwork is normally one of a kind and may be available in a quantity of one only.
We make reasonable efforts to ensure that product descriptions, dimensions, materials, ingredients, photographs and prices are accurate.
Colours may appear differently depending on screen, lighting and device settings.
5. Handmade Products and Natural Variations
Handmade and small-batch products may have reasonable variations in:
- Colour.
- Texture.
- Pattern.
- Shape.
- Weight.
- Dimensions.
- Finish.
- Fragrance or appearance.
These natural variations form part of the handmade character of the product and are not necessarily defects.
This does not affect your rights where a product is faulty, unsafe, damaged, materially different from its description or otherwise fails to conform to the contract.
6. Original Artwork
Each original artwork is individually created and may contain characteristics associated with the artist’s materials, technique and creative process.
Unless expressly stated otherwise:
- The sale includes the physical artwork described on the product page.
- Decorative furniture, frames, room settings or accessories shown in lifestyle photographs are not included.
- A frame is included only where the product description specifically says so.
- Purchasing an artwork does not transfer copyright or reproduction rights.
7. Product Safety and Use
You must read and follow any instructions, warnings, ingredient information and care guidance supplied with a product.
Candles must be used in accordance with their safety label, kept away from children, pets, flammable materials and draughts, and never left burning unattended.
Soap and cosmetic products must be used as directed. Customers with allergies or sensitivities should review the ingredient information before use and seek appropriate professional advice where necessary.
Stop using a product if irritation or an unexpected reaction occurs.
Nothing in this section limits our responsibility for supplying products that meet applicable safety and consumer-protection requirements.
8. Placing an Order
The products displayed on our website are an invitation to place an order and do not by themselves create a binding contract.
When you place an order:
- You submit an offer to purchase the selected products.
- We send an order acknowledgement confirming that we received the order.
- We review payment, availability and order information.
- The contract is formed when we send confirmation that the order has been accepted or dispatched.
An automated order acknowledgement does not necessarily mean that an order has been accepted.
Please review your order carefully before submitting it.
9. Order Acceptance and Cancellation by Us
We may decline or cancel an order for a legitimate reason, including where:
- A product is unavailable or has already been sold.
- Payment is declined, reversed or not authorised.
- The price or product information contains an obvious error.
- Delivery is unavailable or legally restricted.
- Required customer or customs information is missing.
- We reasonably suspect fraud, misuse or unlawful activity.
- Accepting the order would breach applicable law or carrier restrictions.
If we cancel an order after receiving payment, we will refund the amount paid for the cancelled item or order.
We will not cancel an accepted order arbitrarily.
10. One-of-a-Kind Products and Stock Errors
Original artwork may be available in a quantity of one.
Although our inventory system is designed to prevent duplicate purchases, two customers may occasionally attempt to purchase the same one-of-a-kind item before stock information updates.
If this happens, the order successfully completed and accepted first will normally take priority. Any payment collected for an unavailable item will be refunded.
11. Prices
Unless stated otherwise, prices on our website are displayed in pounds sterling (GBP).
The total amount payable will be shown during checkout before you place the order.
Prices may change at any time, but changes will not affect an order already accepted except where there is an obvious pricing error.
Shipping charges, customs duties, import taxes and other applicable charges are handled as described during checkout and in our Shipping Policy.
12. Pricing and Website Errors
We take reasonable care to ensure that prices and product information are accurate.
If we discover an obvious pricing or description error before accepting an order, we may:
- Contact you and offer the option to continue using the correct information; or
- Cancel the affected item and issue a refund.
We will not charge a corrected higher price without your agreement.
13. Promotional Codes and Discounts
Promotional codes:
- Must be used according to their stated conditions.
- Cannot be exchanged for cash.
- May have an expiry date or product restrictions.
- Cannot normally be combined unless expressly permitted.
- Must not be reproduced, sold or used fraudulently.
We may refuse or cancel a promotion where it has been used contrary to its conditions, while respecting any applicable consumer rights.
14. Payment
Available payment methods are displayed during checkout and may include Stripe, PayPal and wallet-based options supported by those providers.
Payment information is processed securely by the selected third-party payment provider. DistingStyle does not store complete payment-card numbers or card security codes on its website.
Your payment provider may apply its own terms, security checks, exchange rates or charges.
Payment must be successfully authorised before an order is dispatched.
15. Shipping Origins
DistingStyle uses different fulfilment locations:
- Original artwork is prepared, packaged and dispatched from Beirut, Lebanon.
- Handmade soaps, candles and selected handmade products may be stocked and dispatched from our United Kingdom fulfilment location.
The applicable fulfilment location, delivery service and shipping cost depend on the products and destination.
For full details, please read our Shipping Policy.
16. Orders From Multiple Fulfilment Locations
An order containing products fulfilled from both Lebanon and the United Kingdom may be divided into separate shipments.
Separate shipments may:
- Arrive on different dates.
- Use different carriers.
- Have separate tracking numbers.
- Have separate shipping or import charges.
Available charges will be shown during checkout before the order is placed.
17. Delivery
We will deliver orders to the address provided during checkout.
You must provide a complete and accurate recipient name, address, postcode, email address and telephone number.
Delivery dates are estimates unless we expressly agree to a guaranteed date.
Unless a different delivery period is agreed, we will deliver within the period required by applicable consumer law.
We remain responsible for the goods until they are delivered to you or to a person you identify to receive them.
18. Customs and Import Charges
Orders crossing international borders may be subject to customs duties, import VAT, clearance charges or other government fees.
Unless expressly stated otherwise during checkout:
- These charges are not included in the product price or shipping charge.
- The recipient is responsible for paying them.
- We do not control or guarantee their amount.
You must provide information reasonably required for customs clearance.
Please review our Shipping Policy for further details.
19. Cancellation, Returns and Refunds
Your cancellation, return and refund rights are explained in our Refund and Returns Policy.
For most eligible online purchases, consumers normally have 14 days after delivery to notify us that they wish to cancel, followed by a further 14 days to return the goods.
Exceptions may apply to:
- Bespoke or commissioned products.
- Products made to your specifications.
- Clearly personalised products.
- Sealed hygiene products after the seal has been broken.
- Other products legally excluded from cancellation rights.
Original artwork offered for general sale is not excluded merely because it is original or handmade.
These exceptions do not remove your rights where goods are faulty, damaged, misdescribed or otherwise fail to conform to the contract.
20. Faulty, Damaged or Misdescribed Products
Products must be:
- Of satisfactory quality.
- Fit for their usual or agreed purpose.
- As described.
- Compliant with applicable consumer law.
If a product is faulty, damaged, incorrect or misdescribed, you may be entitled to a repair, replacement, price reduction or refund, depending on the circumstances.
A request to report visible delivery damage within 48 hours helps us investigate with the carrier but does not limit your statutory rights.
21. Intellectual Property
Website content, including branding, logos, text, product descriptions, photographs, graphics, layouts and designs, is owned by or licensed to DistingStyle LTD and is protected by applicable intellectual-property laws.
Artwork and product designs may remain protected by copyright belonging to the artist, designer, DistingStyle LTD or another rights holder.
Purchasing a physical product does not transfer:
- Copyright.
- Commercial reproduction rights.
- Licensing rights.
- The right to create or sell copies.
- The right to use the work for commercial advertising.
You may not reproduce, modify, distribute, sell, publish or commercially exploit protected content without prior written permission from the relevant rights holder.
22. Reviews and Customer Content
If you submit a review, photograph, comment or other content, you confirm that:
- It is accurate and based on your genuine experience.
- You own it or have permission to submit it.
- It does not infringe another person’s rights.
- It is not unlawful, abusive, misleading or harmful.
You grant DistingStyle a non-exclusive, royalty-free permission to display and use submitted content in connection with the website and promotion of our products, subject to applicable privacy law.
We may remove content that breaches these requirements.
23. Acceptable Website Use
You must not:
- Use the website for fraud or unlawful activity.
- Attempt to gain unauthorised access to the website or another user’s account.
- Introduce malware, malicious code or harmful technology.
- Interfere with the website’s operation or security.
- Scrape, copy or extract website content for commercial use without permission.
- Place fraudulent orders or misuse promotions.
- Infringe intellectual-property or privacy rights.
We may restrict access where reasonably necessary to protect customers, the website or our legal rights.
24. Website Availability
We aim to keep the website accurate, secure and available but cannot guarantee uninterrupted or error-free access.
We may temporarily suspend access for maintenance, security, updates or circumstances outside our reasonable control.
This does not affect contracts already formed or your statutory consumer rights.
25. Third-Party Services and Links
Our website may contain links to third-party websites or use services operated by payment, analytics, advertising, delivery or social-media providers.
Third parties operate under their own terms and privacy policies. We are not responsible for third-party websites that we do not control.
26. Privacy and Cookies
We process personal information as explained in our Privacy Policy.
We use cookies and similar technologies as described in our Cookie Policy. Optional analytics and advertising technologies are used only where the required consent has been provided.
You can review or change your choices using the Manage Consent control on our website.
27. Our Responsibility to Consumers
We do not exclude or limit liability where doing so would be unlawful, including liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Breach of your statutory consumer rights.
- Defective products where liability cannot legally be excluded.
We are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Products sold to consumers are intended for personal use. We are not responsible for business losses, lost profits or business interruption arising from consumer use of the products, except where the law requires otherwise.
28. Events Outside Our Reasonable Control
We are not responsible for delays caused by events outside our reasonable control, such as severe weather, carrier disruption, customs delays, government action, conflict, transport restrictions, natural disasters or major network failures.
If such an event materially affects an order, we will take reasonable steps to minimise the delay and keep you informed.
Your statutory rights concerning significantly delayed or undelivered goods remain unaffected.
29. Changes to These Terms
We may update these Terms to reflect changes in our products, services, fulfilment arrangements or legal obligations.
Updated Terms will be published on this page with a revised effective date.
Changes will apply prospectively. The Terms in effect when your order was accepted will normally continue to govern that order.
30. Severability
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
31. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
32. Governing Law and Jurisdiction
These Terms and contracts between you and DistingStyle LTD are governed by the laws of England and Wales.
If you are a consumer living elsewhere, you retain any mandatory protections provided by the laws of your country of residence.
Consumers may bring proceedings in the courts available to them under applicable law.
